Buy Rent Kenya Limited is the data controller for the personal data described in this policy. If you have a question about anything here, use the privacy contact details below.

You give us personal data when you:

• create an account or sign in
• verify an email address or a phone number
• send an enquiry, request a callback or reveal a listing's contact details
• save a Property Match or turn on alerts
• subscribe to our newsletter
• fill in any other form on the site

That data is normally your name, your email address and your phone number. Where you send an enquiry it also includes whatever you write in the message.

We also collect technical information automatically when you visit, including your IP address and the pages you looked at. This helps us understand how the site is used and where to improve it.

The law requires us to have a lawful basis for everything we do with your personal data. We rely on two, and which one applies depends on the purpose.

This is the core of what the site does, so we set it out plainly.

When you contact a listing we send your name, your phone number and your email address to whoever advertises that listing. That happens when you reveal a phone number, start a WhatsApp conversation, send an enquiry or request a callback. It happens each time you contact a listing, including listings advertised by different agents.

We tell you this at the point where we first collect and verify your details. We do not ask again for each listing, because sending your details is the service you are asking for when you click.

Once we have sent your details, the agent, agency or private seller is responsible for them in their own right. They decide how they store them and how long they keep them, and their own privacy policy applies. We cannot recall an enquiry after it has been delivered.

We do not pass your personal data to advertisers, data brokers or anyone else for their own marketing. The only people we send your details to are the agents, agencies and sellers described above, and only for the reasons described there.

A Property Match saves your search so that we can watch for new listings that fit it. It has two separate settings and both are off unless you turn them on.

Email alerts send you new listings that match your saved criteria. Turning this on is your consent to receive those emails, and you can pause them at any time from your Property Match.

Agent contact lets agents whose listings match your Property Match unlock your contact details and approach you, including where you have not contacted them first. Turning it on is your consent for us to share those details with them for that purpose. An agent who unlocks sees both your phone number and your email address. You choose which one you would prefer them to use, how many agents may unlock and for how long. You can pause it at any time, which stops any further agents unlocking your details. Agents who already hold your details keep them, as described in the section above.

If you subscribe to our newsletter we send you marketing emails about listings and property news. That is based on your consent, and every one of those emails carries a link to unsubscribe. You can withdraw your consent at any time.

We limit disclosure of your personal data. Beyond the agents, agencies and sellers described above, we may share it with:

• companies in our group and the service providers we engage to run the site, send our emails and messages, host our data and process payments. Each one is bound by a written contract requiring it to protect your data and to use it only as we instruct.
• law enforcement agencies, government bodies, regulators or courts, where the law requires or permits it. Under the Computer Misuse and Cybercrimes Act, for example, a law enforcement agency may require a service provider to retain or release traffic data, subscriber information or content.
• a third party where disclosure is needed to satisfy a legal or regulatory requirement, for example to detect or prevent fraud or another crime.
• a merging or acquiring entity, if we go through a reorganisation such as a merger, an acquisition or a takeover.

We store and process personal data on servers outside Kenya. The Data Protection Act, 2019 permits this on specific grounds. We rely on the transfer being necessary to perform our agreement with you, and on our assessment that the receiving country offers adequate protection. We take the steps needed to make sure your data is transferred and held securely.

Cookies are small files a website places on your browser. We use them to keep you signed in, to remember your preferences, to keep the site secure and to measure how the site is used. Some are session cookies that last only as long as your visit; others persist so that you do not have to sign in again each time.

You can block or delete cookies through your browser settings. Blocking them may stop parts of the site working properly, including staying signed in.

We use Google Analytics to understand how the site is used. It sets cookies and sends usage data to Google, including a shortened form of your IP address. Google processes that data on our instructions and reports on site activity for us. You can stop Google Analytics collecting your activity by installing the Google Analytics opt-out browser add-on .

We also work with advertising and retargeting partners — Meta (Facebook and Instagram), Criteo and Google Ads. They set cookies and receive information about the pages and property listings you view on this site, so that the adverts you are shown elsewhere are more relevant to you. They do not receive your name, phone number or email address from us.

You can control this in the same way as any other cookie, through your browser settings, and each partner also offers its own controls: the Meta ad preferences page, the Criteo privacy centre , and Google Ads settings .

We keep your personal data only for as long as we need it for the purposes set out here, or for as long as the law requires. Once it is no longer needed we delete it or anonymise it.

We take the security of your personal data seriously. We have technical and organisational measures in place, and we require our staff and anyone working on our behalf to meet appropriate security standards.

You can ask us to:

• give you a copy of the personal data we hold about you
• correct it where it is wrong or out of date
• delete it
• restrict what we do with it
• tell you about a specific use of it
• stop using it for a purpose you consented to, by withdrawing that consent

Withdrawing consent does not affect anything we lawfully did with your data before you withdrew it. Where we rely on providing the service rather than on your consent, the way to stop that processing is to close your account.

Email the privacy contact address from the address on the account, with a clear subject line and a short reason. We will delete or anonymise your account and the enquiries held against it.

Two limits are worth knowing. Deleting your account stops us sharing your details in future, but it does not recall enquiries we have already delivered: each agent, agency or seller holds its own copy, and you would need to contact them directly. We may also keep a limited record where the law requires us to.

Technology and the law change, so we may update this policy from time to time. The current version is always the one on this page.
