BuyRentKenya, we, our, and us refer to Buy Rent Kenya Limited. Site refers to www.buyrentkenya.com and mobile versions of the website and software applications derived from it. Advertisers and listers refer to private sellers, agents, property developers, landlords, and ancillary partners.

You do not need an account to use the Site, but certain areas are only available to registered users. If you create an account, you will be required to submit certain personal information as part of registration. Our Privacy Policy governs how we handle that information — please review it carefully.

The information on this Site is for your personal use only.

• You should not sell, redistribute, or use the information for any commercial purpose (including using an advertiser’s contact details for unsolicited commercial correspondence).
• You should not become a registered user in order to access, modify, copy, reproduce, republish, upload, post, transmit, or distribute Content on behalf of others for financial gain.
• You should not modify, copy, reproduce, republish, upload, post, transmit, or distribute Content, or use the Site for any unlawful purpose or purpose prohibited by these Terms.
• You should not use data mining, robots, screen scraping, or similar tools to extract or reproduce Content for use on your own website or in any other publication, except with BuyRentKenya’s prior written consent.
• Accessing membership areas requiring login, without permission, for non-personal or commercial use constitutes trespass.

You may download material from the Site for personal use, provided you comply with the Copyright provisions and keep all copyright and proprietary notices intact.

You undertake that you will not, by act or omission, mislead or deceive others while using the Site. Where a valid third-party complaint is made, or BuyRentKenya’s own investigation establishes that you have misled or deceived others, BuyRentKenya has the right to suspend your account.

To become a registered user, you must provide login details. You are solely responsible for maintaining their confidentiality and for all activity occurring under your account. You may change your login details through the Site or by contacting customer service. You must immediately notify BuyRentKenya of any unauthorised use of your account or any other known breach of security.

We welcome ideas and feedback about the Site. We may reproduce, distribute, transmit, create derivative works of, and publicly display any materials or information (including ideas for new or improved products and services) that you submit to public areas of the Site or via email or other communication. While BuyRentKenya has safeguards in place and takes due care to protect the privacy and integrity of personal information you provide, it is possible that information could be unlawfully accessed or disclosed while in transit over the internet or while stored on BuyRentKenya systems. The Site may link to internet sites maintained by third parties, provided for your convenience. Inclusion of a link does not imply endorsement of the linked site. Such linked sites are not under BuyRentKenya’s control; we are not responsible for their content (including accuracy, legality, or decency), their compliance with intellectual property law, or any damages or loss arising from any information or third-party service they provide.

BuyRentKenya may modify these Terms at any time; modifications take effect immediately upon posting on the Site. For registered users, BuyRentKenya may, at its discretion, post a notification of updated terms on your account.

If any part of these Terms is or becomes invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it valid, legal, and enforceable; if modification is not possible, the provision will be deemed deleted. This does not affect the validity or enforceability of the rest of the Terms.

We may transfer our rights and obligations under these Terms to another organisation. We will notify you in writing if this happens, and will ensure the transfer does not affect your rights under these Terms.

Termination of these Terms does not end provisions capable of surviving termination, and does not affect any rights, remedies, obligations, or liabilities that accrued before termination.

These Terms are governed by the laws of Kenya, and you irrevocably submit to the exclusive jurisdiction of its courts.

Cookies are small messages or files placed on your web browser when you visit a website. They allow a website to recognise a user’s device and improve the online experience, among other functions.

We use cookies to make the Site work better and to understand how you use it. Cookies let us offer tailored products and interpret information about your use of our Site (and, where applicable, other websites and apps), whether or not you have an account with us. They help us provide, protect, and improve our products and services by personalising and measuring them, authenticating users, assessing performance and functionality, and carrying out analytical research.

• No misrepresentation: you must not, by act or omission, mislead or deceive other users. A valid complaint, or BuyRentKenya’s own investigation, that finds you have misled or deceived others gives BuyRentKenya the right to suspend your account.
• Account security: you are solely responsible for your login details and all activity under your account, and must notify BuyRentKenya immediately of any unauthorised use.
• No commercial reuse of Site data: you may not use another advertiser’s contact details for unsolicited commercial correspondence, or scrape/data-mine listing content for use elsewhere without written consent.

• Listings must relate to real, currently available property that the advertiser has the right to market (as owner, landlord, authorised agent, or developer).
• Listing price, location, size, and property details must be accurate and kept up to date; listings must be removed or marked unavailable promptly once a property is sold, let, or withdrawn.
• Photos must depict the actual property being advertised and not be misleading, watermarked with a third party’s branding, or infringe someone else’s copyright.
• Duplicate listings for the same unit by the same advertiser are not permitted.
• Listings must not contain discriminatory language relating to race, religion, ethnicity, gender, disability, or family status.
• Contact details provided in a listing must belong to the advertiser or their authorised representative.
• BuyRentKenya reserves the right to edit, suspend, or remove any listing that breaches these rules, applicable law, or the Terms of Use, without notice.

You acknowledge and agree that information published on the Site is intended to provide general information in summary form about property and related matters. It does not constitute advice which should be relied upon.

BuyRentKenya does not endorse or recommend any advertiser, agent, property developer, private seller, ancillary partner, potential buyer, property, or service advertised on the Site. We strongly recommend you obtain your own independent legal, accounting, financial, customer-reputation, reference, background-checking, or taxation advice as appropriate before entering into any agreement with an advertiser or any other third party.

It is your sole responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, merchandise, products, and other information provided through the Site. BuyRentKenya will not be liable for any decision you make or action you take in reliance on information contained on, or omitted from, the Site.

BuyRentKenya gives no guarantee of the continued availability of any property or product advertised on the Site, and will not be liable should an advertiser have sold or withdrawn a property at any time prior to removal of the listing. While we make efforts to ensure advertisers and potential buyers are genuine and that property/buyer data is accurate, we give no guarantee that every listing description is free from errors or inaccuracies.

BuyRentKenya does not provide financial, legal, tax, or investment advice through the Site, and nothing on the Site should be construed as such. Any figures, calculators, guides, or estimates published on the Site (e.g. pricing trends, mortgage or affordability estimates) are for general informational purposes only and should not be relied upon as a substitute for professional advice. You should obtain independent legal, financial, or taxation advice before entering into any transaction relating to a property advertised on the Site.

We do not warrant that the services available through the Site will be uninterrupted or error-free, or that defects will be corrected. We do not guarantee or warrant that files available for download, or delivered via email through the Site, will be free of infection, viruses, worms, Trojan horses, or other destructive code. You are responsible for implementing sufficient procedures to satisfy your own requirements for accuracy of data input and output, and for maintaining a means external to the Site to reconstruct any lost data.
